VCAT Binary Code License
It is RIKEN's intention to open public under this license the binary code for the VCAT developed as a result of RIKEN's research and study for the purpose for a wide availability and further development through the use by many users.
Implementation of this license
- Any downloading, use, reproduction or redistribution of the VCAT binary code is deemed to be acceptance of the terms and conditions specified in this License and to be an agreement to enter into a license agreement with RIKEN under the terms and conditions of this license.
1 Scope of this license

2 Definitions
In this license, the following words shall have the following meanings:

2.1 The "Terms and Conditions" shall mean the terms and conditions set forth in this license for VCAT binary codes. - License
2.2 This "License" shall mean the license for use, reproduction, and redistribution of the Binary Codes. - User
2.3 The "User" shall mean anyone who downloaded the Binary Codes and enter into the License to use them under the Terms and Conditions. - Binary code
2.4 The "Binary Codes" shall mean the VCAT binary codes (including manuals, sample data, image files) to be licensed by RIKEN to the Users under the Terms and Conditions.
3 Copyright and License

3.1 The copyright for the Binary Codes belongs to RIKEN. However the copyright for a certain Binary Codes are owned by a certain parties who granted to RIKEN the right to open them public and to license them under the Terms and Conditions. -
3.2 Non-commercial Uses: RIKEN grants to a royalty-free nonexclusive license to use, reproduce, redistribute and display the Binary Codes only for the non-profit and non-commercial purpose to the Users who agreed or are deemed to have agreed with the Terms and Conditions of this License. -
3.3 Commercial Use: In case that any license is requested for use, reproduction, redistribution or display of the Binary Codes for any profit or commercial purpose, RIKEN will decide the terms and conditions for such a license for a profit or commercial purpose, separately from this License, upon the negotiation with the users requesting such a license. -
3.4 In the event that RIKEN receives any monetary consideration for a license for a profit or commercial purpose, such consideration will be used for further promotion and continuous development of the VCAT, in view of the contribution by unlimited number of the Users of the VCAT.
4 Prohibitions regarding modification of Binary Codes

4.1 Users must not reverse-engineer or decompile binary code. -
4.2 Users must not modify binary code.
5 Redistribution

5.1 Users may redistribute the Binary Codes to third parties in accordance with the Terms and Conditions under the condition that such third parties also accept and agree with all of the Terms and Conditions. 5.2 Any persons or entities who obtained the Binary Codes from Users are also deemed to be Users under this License and to have agreed with the Terms and Conditions.
6 Patent Licenses

6.1 RIKEN owns certain patents related to the VCAD System binary code. -
6.2 Any use, reproduction, redistribution and display of the Binary Codes may constitute the use or exercise of the patented inventions owned by RIKEN. -
6.3 Non-commercial use of Patents: RIKEN grants, to the Users who agreed with the Terms and Conditions, a non-exclusive royalty-free license under said patents as far as the use, reproduction, redistribution and display of the Binary Codes is for a non-profit and non commercial purpose. -
6.4 Commercial Use of Patents: RIKEN may, at its discretion and upon the negotiation, decide to grant a license and the conditions for commercial use in relation to the use or exercise of the patented inventions relating to the use, reproduction, redistribution and display of the Binary Codes.
7 Disclaimer of Warranties and Liabilities

7.1 The Licensed Programs are provided without any warranty of any kind, either expressed, implied, or statutory, including, but not limited to, any warranty that the Licensed Programs will conform to specifications, any implied warranties of merchantability, fitness for a particular purpose, or freedom from infringement. RIKEN disclaims all warranties and liabilities regarding the any kind of damages. -
7.2 Users agree to decide, at their own risks and responsibility, the appropriateness for the use or redistribution of the Binary Code and to waive any and all claims against RIKEN regarding the use or redistribution of the Licensed Programs even if Users' exercise of licensed rights granted under the Terms and Conditions resulted in any liabilities or damages.
8 Governing Laws and Jurisdiction

8.1 The License and the Terms and Conditions are governed by the laws of Japan. Any disputes that arise out of or in relation to the License and the Terms and Conditions shall be subject to the exclusive jurisdiction of the Tokyo District Court in Tokyo, Japan.
9 Notice required for Redistribution when redistributing binary code
- Users shall attach the copyright notice written below for the redistribution of the Binary Codes. Users are recommended to also include the name of the file and class together with a summary explanation of the program on the same page as the copyright notice, so that the programs can be easily identified within the third party's archives.
